Understanding Victoria's Occupational Health and Safety Framework
Victoria is one of the few Australian states that has not adopted the harmonised model Work Health and Safety legislation. Victorian workplaces operate under the Occupational Health and Safety Act 2004 (VIC), not the model WHS Act, a distinction that matters when you’re managing duties, penalties, and documentation.
WorkSafe Victoria administers the Act and has broad inspection and enforcement powers. For high-risk work, employers must ensure workers hold current high-risk work licences issued under the Occupational Health and Safety Regulations 2017 (VIC).
Key obligations relevant to on-site training:
- High-risk work licences: Required for forklift operation, EWP, scaffolding, rigging, and other prescribed work. Licences are issued nationally but must meet VIC regulatory requirements.
- Safe work method statements (SWMS): Required for high-risk construction work under the OHS Regulations.
- WorkSafe Victoria: Has authority to issue improvement notices, prohibition notices, and prosecute for OHS Act breaches.
On-site training delivered in your actual operating environment, against your specific hazards and site conditions and supports genuine compliance and is more defensible in a WorkSafe inspection than generic classroom certification.

Common Questions from Victorian Operators
Does Victoria use the same WHS laws as other states?
No. Victoria operates under the Occupational Health and Safety Act 2004 (VIC), not the harmonised model WHS Act used by most other states. The practical obligations for employers are broadly similar, but the legislation, penalties, and regulator (WorkSafe Victoria) are specific to the state. All Link Resources training meets both national ASQA standards and Victorian OHS requirements.
We're a construction company with multiple sites across Victoria. Can you train at each site?

How far in advance do I need to book?
For outer metropolitan and major regional centres (Geelong, Ballarat, Bendigo, Traralgon, Shepparton), we can often confirm within a week. For more remote locations in Gippsland or the Mallee, 2–4 weeks lead time is recommended. Contact us and we’ll advise.
Is the training the same standard as what's delivered in your training centres?
The qualification is identical; same unit of competency, same nationally recognised outcome. On-site delivery is contextualised to your workplace and your hazards, which makes it more effective for workers and more defensible for a WorkSafe Victoria inspection.
